T & C's - STANDARD DEBTOR TRACING ('SDT')

All Standard Debtor Tracing Instructions are received on a no trace, no fee basis, against a fixed fee (currently R 260.00 plus VAT).
 
bullet Trace reports are valid for 60 days from date of issue.
bullet SDT fees are payable no later than 60 days from date of invoice (which is submitted with the trace report) regardless of whether client is in receipt of a Return of Service from the Sheriff of the Court. If service is attempted after the 60 day guarantee period has expired, and the Sheriff produces a Return of Non-Service, FSG's SDT fee shall nonetheless be payable. Interest at 2% per month (or part thereof) is charged on overdue amounts.
bullet The Standard Trace Procedure ('STP') is performed by FSG's Desk-Bound-Tracers ('DBT'), who trace debtors from behind a desk using a telephone, access to the Internet, a vast range of online databases, and an informer network that affords FSG access to a variety of confidential records.
bullet FSG will endeavour to obtain both residential and employment particulars but does not guarantee obtaining both. However, if client specifically instructs that either residential or employment details are required, and FSG is unable to provide the requested information, no fee is raised.
bullet A successful trace is one for which FSG produces a 'trace report'.
bullet An unsuccessful trace is one for which FSG produces a 'no-trace report'.
bullet A positive trace report is a successful trace report produced by FSG that results in the Sheriff of the Court successfully serving legal process. FSG's SDT fee is only payable if FSG's successful trace report becomes a positive trace report.
bullet If the subject of a SDT is a deceased natural person, FSG will automatically establish the Master's file reference number and the details of the Executor, and this shall be regarded by client as a positive trace report.
bullet If the subject of a SDT instruction is an insolvent natural person, FSG will automatically establish the Master's file reference number and the details of the Trustee, and this shall be regarded by client as a positive trace report.
bullet If the subject of a SDT instruction is a liquidated juristic person, FSG will automatically establish the Master's file reference number and the details of the Liquidator, and this shall be regarded by client as a positive trace report.
bullet A positive trace report is also a successful trace report for which the Sheriff of the Court has not:
bullet Attempted the service of process within the 60 day guarantee period.
bullet Has not complied with the implications of any of the qualifiers included in FSG's successful trace report.
bullet FSG requires a minimum mandate period of 30 days for all SDT instructions, but strives for a 14 day turn-around period.
bullet All successful trace reports issued by FSG are qualified in two ways. The assigned tracer will attempt:
bullet To establish the time of the day and the day of the week that service is most likely to be successful at either the residential or employment address of the traced debtor. If the tracer is unable to establish this, FSG's trace report will say so.
bullet To obtain independent verification of the debtor's traced residential/employment details. FSG's successful trace report will state whether the traced details were verified, and if so, how.
bullet If FSG qualifies its SDT report, and the service of process within the guarantee period is made on a date and at a time that is contrary to that specified by FSG for a particular address, and the result is a Return of Non-Service, client shall not be entitled to request re-trace for the original fee raised. If FSG is instructed to re-trace a debtor under these circumstances, FSG shall be entitled to raise a second SDT fee and client shall be obliged to pay both SDT fees raised by FSG.
bullet FSG will only reverse its fee for a successful trace report if, in respect of a Return on Non-Service:
bullet Service was attempted in the 60 day guarantee period.
bullet Service was attempted in accordance with the implications of qualifiers,
bullet FSG is given the opportunity to re-trace the debtor in question.
bullet Statistically:
bullet FSG will produce a successful trace report for 75% of all SDT instructions received.
bullet Less than 3% of all successful trace reports produced by FSG will result in a Return of Non-Service from the Sheriff of the Court.
bullet 90% of trace reports resulting from re-trace instructions will result in a positive Return of Service.
