T & C'S - FORENSIC INVESTIGATIONS, AUDITS & RISK MANAGEMENT SERVICES

All forensic investigations & audits, and risk management services are rendered against FSG's base investigation/auditing/risk management services tariff (currently R 600.00/hour plus VAT per operative simultaneously assigned to the same task, plus costs and disbursements, as set out in our TARIFF LIST - which is available upon request). However, our hourly tariff is subject to quotation after we have assessed an instruction/enquiry and have provided for the cost of any outsourced professional or scientific discipline that must be applied forensically to satisfy an instruction, and after consideration of any extraordinary risks to which FSG will be exposed as a consequence of attending to a specific instruction.

 
bullet The acceptance of all forensic investigations, audits and risk management services instructions is subject to the production of a service proposal by FSG, and client's written acceptance of same. Service proposals are usually produced at FSG's own cost, but FSG reserves the right to raise a fee for the production of a service proposal if deemed necessary by the scope of work required to produce the service proposal. However, FSG may only raise a fee for the production of a service proposal if a fee is agreed to in advance by client.
bullet Service proposals set out the anticipated scope of work of the investigation, audit, or risk management service, FSG's anticipated fee, FSG's anticipated costs and disbursements, and the number of hours that FSG proposes that client should budget for FSG to attend to each component of the scope of work proposed. FSG does not guarantee that any budget agreed to is adequate to complete the scope of work indicated, but we warrant that we will not perform any work in excess of what is permitted by any initial budget agreed between FSG and client WITHOUT first reverting to client with a detailed report and accounting so that client can make an informed decision whether to instruct FSG to proceed with the task to complete any work indicated to be outstanding at that time. Before further work proceeds, FSG again constructs a service proposal for the further work indicated, to which we put fee estimates and in respect of which we quantify our anticipated costs and disbursements. FSG then again proposes a budget to complete the outstanding scope of work, and will only proceed with the work upon written confirmation of client's approval of the further scope of work and budget proposed. In this manner, client is always in a position to assess FSG's work, will NEVER receive an invoice from FSG that is in excess of what client anticipated, and client has the final control over the final fee of FSG.
bullet No work will commence on any investigation, audit or risk management service until FSG is in receipt of advance payment of a sum equivalent to 50% of any budget agreed to, plus receipt of any amounts FSG shall need to disburse to informants to obtain access to confidential databases/records (such as those referred to in the DATABASE INTEL page of the INVESTIGATION MENU BAR). If it is necessary to call for additional budgets to satisfy an instruction, the balance of our fee outstanding at that time is to be settled and 50% of the further budget agreed to must be paid before further work commences. Upon completion of the investigation/audit/risk management service, our outstanding fee at that time is payable within 14 days of presentation of our final report and invoice. Interest at 2% per month (or part thereof) is charged on overdue amounts.
bullet Whatever else is the case, FSG reserves the right to call for settlement of all fees due for work done and for costs and disbursements incurred on the monthly anniversary of the date of instruction, if the duration of a forensic investigation/audit/risk management task is greater than 30 days.

It should be clear that the evolvement of a scope of work and the setting of a budget to attend to that work is intended to be the product of consultation between FSG and client to avoid any cause for disagreement. It is also the case that our service proposal stands as a SERVICE LEVEL AGREEMENT by which client can assess our efforts.
