STANDARD DEBTOR TRACING ('SDT')

All STANDARD DEBTOR TRACE ('SDT') instructions are received on a no trace, no fee basis, against a fixed fee (that is currently R 260.00 plus VAT).
 
bullet The scope of work of SDT is FSG's STANDARD TRACE PROCEDURE ('STP'), which is also a component of the scope of work of all categories of TRACING SERVICE offered by FSG. The STP is performed by FSG's DESK BOUND TRACERS who are variously based at FSG's corporate offices in DURBAN, JOHANNESBURG and CAPE TOWN. DBT trace debtors from behind a desk using the resources of a telephone, access to the internet and a vast range of online databases that store the details of persons and entities, email, and access to an informer network that affords FSG access to numerous confidential records
bullet The STP is specifically designed to trace persons who are active - or who were recently active - in the credit environment, and for the purpose of providing a residential or employment address at which the Sheriff of the Court can serve debt recovery-related legal process. While the STP can be used to locate persons for other purposes (eg. to trace a witness, a beneficiary of a deceased estate, etc.), the STP will only be successful if the last known particulars of the subject of the SDT instruction ('SUBJECT') were recently accurate and if effective if SUBJECT is active - or was recently active - in the credit environment. Clients are welcome to instruct FSG to perform a SDT in terms of our STP for whatever reason (and benefit from the limited fee and 'no trace, no fee' term on which FSG accepts SDT instructions). However, if the last known information of SUBJECT is old and limited, the recommended method of locating such a person would be to instruct FSG to perform our MISSING/SOUGHT PERSON FORENSIC INVESTIGATION, in which case our investigation tariff and our terms and conditions for the provision of forensic investigation services will apply.
bullet SDT reports are valid for 60 days from date of issue.
bullet SDT fees are payable no later than 60 days from date of invoice (FSG produces an invoice with each SDT report) regardless of whether client is in receipt of a Return of Service from the Sheriff of the Court.
bullet FSG will endeavour to obtain both residential and employment particulars for SUBJECT, butt does not guarantee obtaining both. However, if client specifically instructs that either residential or employment details are required, and FSG is unable to provide the requested information, no fee is raised.
bullet A successful SDT is one for which FSG produces a 'trace report'.
bullet An unsuccessful SDT is one for which FSG produces a 'no-trace report'.
bullet A positive SDT is a successful SDT that results in the Sheriff of the Court successfully servicing legal process on SUBJECT. FSG's SDT fee is only payable if FSG's successful SDT report becomes a positive SDT report.
bullet If SUBJECT is discovered to be deceased, FSG will automatically establish the Master's file reference number and the details of the Executor, and this shall be regarded by client as a positive SDT report.
bullet If SUBJECT is an insolvent natural person, FSG will automatically establish the Master's file reference number and the details of the Trustee, and this shall be regarded by client as a positive SDT report.
bullet If SUBJECT is a liquidated juristic person, FSG will automatically establish the Master's file reference number and the details of the Liquidator, and this shall be regarded by client as a positive SDT report.
bullet A successful SDT report is also a positive SDT report for which the Sheriff of the Court has not:
bullet Attempted the service of process within the 60 day guarantee period.
bullet Has not complied with the implications of any of the qualifiers included in FSG's successful SDT report.
bullet FSG requires a minimum mandate period of 30 days for all SDT instructions, but strives for a 14 day turn-around period.
bullet All successful trace reports issued by FSG are qualified in two ways. The assigned DBT:
bullet Will attempt to establish the time of the day and the day of the week that service is most likely to be successful at a given traced address. If the DBT is unable to establish this, FSG's successful SDT report will say so.
bullet Will attempt to obtain independent verification of the accuracy of SUBJECT's traced residential/employment address.  FSG's successful SDT report will state whether the traced details were verified, and if so, how.
bullet If FSG qualifies its successful SDT report, and the service of process within the guarantee period is made at a given address on a date and at a time that is contrary to that specified by FSG for that address, and the result is a Return of Non-Service, client shall not be entitled to request re-trace for the original fee raised. If FSG is instructed to re-trace a debtor under these circumstances, FSG shall be entitled to raise a second SDT fee.
bullet FSG will only reverse its fee for a successful SDT report if:
bullet Service was attempted in the 60 day guarantee period.
bullet Service was attempted in accordance with the implications of qualifiers,
bullet FSG is given the opportunity to re-trace a debtor for which our successful trace report resulted in a Return of Non-Service from the Sheriff of the Court.
bullet A copy of the Return of Non-Service accompanies client's instruction to re-trace SUBJECT.
bullet Statistically:
bullet FSG will produce a successful trace report for 75% of all SDT instructions received.
bullet Less than 3% of all successful trace reports produced by FSG will result in a Return of Non-Service from the Sheriff of the Court.
