THE PUBLIC PROTECTOR, SOUTH AFRICA

We are honoured to announce that FSG has been appointed to the newly established PANEL OF INVESTIGATORS OF THE PUBLIC PROTECTOR, SOUTH AFRICA in the capacity of "investigative resource of The Public Protector". The appointment of FSG by The PUBLIC PROTECTOR marks the achievement a priority objective of FSG, namely to secure recognition at the level of national government of FSG's capacity and expertise to investigate the likes of corruption and abuse of power on the part of politicians and civil servants (usually in collusion with private business).

  • The detection, investigation, prosecution and prevention of CORRUPTION is of unique interest and importance to FSG, for two reasons:
    The first reason is the work itself. Because highly collusive relationships are a cornerstone of corrupt practices, investigating and prosecuting corruption is challenging!

  • The second reason speaks to the culture of FSG. We are firmly of the opinion that corruption and the abuse of authority for personal gain by politicians and civil servants is a scourge that threatens the very foundation of our government and democracy. More significantly, corrupt practices defeat the objectives of black empowerment because it undermines the capacity of government to deliver services and to install infrastructure to the benefit of HDI groups.

The PUBLIC PROTECTOR is an organ of State created by the Public Protector Act, Act 23 of 1994, to uphold and enforce CONSTITUTIONAL DEMOCRACY in South Africa. The PUBLIC PROTECTOR is an ombudsman-type body that any person (natural or juristic, in his/her personal capacity or on behalf of another) may approach to seek remedy in respect of any instance of maladministration, poor or improper service delivery, non-delivery of services, a vast range of statutory criminal offences when committed by politicians and civil servants, and improper conduct (including the likes of corruption, theft, fraud, unjust enrichment, nepotism, abuse of authority/office, tender fraud and procurement irregularities, abuse of state/government assets/resources - and many more) on the part of politicians and/or civil servants, but on condition that the complainant has exhausted all other intrinsic remedies provided for by legislation that is specific to the subject matter of a complaint/offence, or that could otherwise be addressed by the civil or criminal courts. The PUBLIC PROTECTOR also autonomously initiate investigations into suspicions or reports of such acts.

The PUBLIC PROTECTOR is mandated to enforce and/or sanction offences, and to mediate the resolution of disputes, in respect of the following Acts of Parliament:

It must be realised that, legislatively, The PUBLIC PROTECTOR is an individual person whose rank is the equivalent of that of a High Court judge. Furthermore:

The Public Protector Act enshrines the autonomy of the PUBLIC PROTECTOR (in much the same manner that our Constitution enshrines the autonomy of our judiciary).

Is currently ADVOCATE MS THILU MADONSELA (who has held the position since 2009).

Has a national infrastructure of offices and employees to assist her to fulfil her mandate.

Has the right of SUBPOENA, SEIZURE, WARRANT, CRIMINAL SANCTION, MEDIATION and ALTERNATE DISPUTE RESOLUTION

May delegate her mandate and rights to ANYONE to assist her to investigate matters that fall within her mandate and to mediate the resolution of complaints.

Has earned a fierce reputation for the delivery of swift and appropriate justice - without regard to rank or political affiliation - especially since the appointment of Advocate Madonsela. (Her recent investigation of National Police Commissioner Bheki Cele in respect of the improper conclusion of leases over two properties that could have encumbered government in an amount of R 1.6 billion, and the consequent suspension of the National Police Commissioner, is a case in point that demonstrates the authority, credibility, effectiveness and autonomy of The PUBLIC PROTECTOR.)
