CONFIDENTIALITY

FSG understands that clients expect that every instruction/service enquiry to FSG is accepted in absolute CONFIDENCE.

Unlike the privilege of confidentiality of the 'attorney and client' relationship that is protected by law, the relationship between 'private/forensic investigator/auditor/tracer/risk manager and client' is not automatically confidential just because FSG declares that it is so.

While (forensic) investigators/auditors/risk managers/tracers in private practice will always claim to guarantee that everything between them and their clients is confidential, there is nothing in law (excluding civil rights issues, due process and, in the case of FSG, the legal framework in which FSG is instructed by THE PUBLIC PROTECTOR) that protects the records and activities of such service providers from the power of SUBPOENA, or that prevents a court from issuing an order that their activities/communication are to be monitored.

There are two circumstances under which FSG can guarantee client CONFIDENTIALITY, but both have limitations.

The FIRST derives from the principle of Roman-Dutch law, English law and the Constitution of South Africa (which form the basis for South African statutory and common law) that a person is presumed innocent until proven guilty. If we maintain records in a manner that anything a client expects FSG to keep confidential CANNOT BE DISCOVERED BY SUBPOENA, the presumption of innocence has the effect that FSG maintains the confidentiality of such records. Consequently:

Records are stored in a manner that only certain employees have access to certain categories of records, and so that access to all records is limited to only two persons within FSG.

Particularly sensitive records are stored securely on premises not associated with FSG.

All case files are stored only at our head office (if not at a remote location) in a secured manner.

Our computers are networked only for the purpose of enabling our IT Manager to monitor activity on individual computers such that efforts to access unauthorised websites, engage in unauthorised communication and copy protected information raise an alarm.

The broadband usage of every employee is monitored for excessive consumption.

bullet

All employees sign a confidentiality agreement that is binding in perpetuity.

bullet

Our contracts of employment provide that FSG may monitor the activities of employees by any means deemed necessary by FSG, and that FSG has the right to subject employees to polygraph examinations if FSG has any reason to question the activities or statements of an employee.

If a client requires FSG to obtain information/records from a confidential database/source, client is required to sign an agreement that such information/records remain confidential between client and FSG, and cannot be revealed to a third party unless obtained by means of subpoena.

FSG will NEVER reveal the name of a client for reference purposes without first obtaining permission to do so.

We randomly monitor all telephonic communication, and access to fax facilities is subject to supervision.

We have installed a telephone  management system so that calls can be monitored by user. Cellphone and landline detailed billing statements are audited monthly to identify who employees are calling.

We enforce a clean desk policy.

No file may leave our office premises without written permission.

The discussion of sensitive material with clients is only conducted in a controlled environment, usually at a location other than our offices.

Our offices are monitored by CCTV.

However, the effectiveness of these measures is qualified. If a policing or prosecutorial authority secures a subpoena to monitor our communication and activities, the maintenance of absolute confidentiality may be compromised.

The SECOND is when a client instructs FSG through an attorney (which is always the recommendation of FSG). This has the effect of extending the confidentiality privilege of the 'attorney and client' relationship to FSG. However, evidence that is admissible in legal proceedings must be  GATHERED IN A LAWFUL MANNER. While our records can be protected from subpoena when FSG is instructed by an attorney, we may be required to testify in legal proceedings, and the manner in which we gathered evidence could be subjected to scrutiny. Consequently, if a client instructed that we access confidential records through informants in the process of an investigation, we recommend that we are not called testify. Furthermore, it is always FSG's objective to avoid having its investigators/auditors called as witnesses if an investigation/audit/risk management/tracing instructiom involved accessing confidential records. Instead, we make every effort to direct matters so that the persons who are the source of the evidence gathered are called as witnesses. Our position is simply that the greater our anonymity, the greater our capacity to investigate successfully.

This PREFERRED ANONYMITY of FSG also finds expression in all the processes, methodologies and polices of FSG:

FSG will not comment to the media unless instructed to do so by a client.

Our office premises are discreetly occupied. Signage reflects our name and contact details, but not what we do.

None of our vehicles  display identifying markings or signage and all are registered in the name of a party that is not FSG.

Employees do not overtly display company identity cards.

bullet

Other than security guards, FSG employees do not wear any corporate apparel that associates them with FSG.

Other than the platform of this website and listing only our name and contact details in directories, FSG does not advertise its existence or services to the general public.

We employ a direct marketing method. We identify relevant decision-makers in our target markets and make personal introduction to such persons. To this end, FSG has developed (and continues to develop) extensive databases of relevant decision-makers in our target markets, to who we circulate, by email, two communiqués each month; a newsletter-type communiqué  and an extract from our CEO''s INVESTIGATION DIARY.
