SECOND PHASE TRACING ('2PT')

There will always be habitual bad debtors who are savvy at evading the legal recovery process by means of:

  • Making themselves untraceable and/or

  • Successfully hiding their income and assets.

Such debtors cannot successfully be traced using the limited scope of work of the Standard Trace Procedure ('STP').

A 'no-trace report' resulting from a SDT does not mean a debtor cannot be traced. It only means that it is not financially viable for a tracing agency to trace a savvy debtor by employing the limited scope of work of the STP that is permitted by the limited, fixed fee that legal practitioners/registered debt collectors are prepared to pay for a SDT (and for which the tracing agency only gets paid if a successful trace report results in a positive Return of Service from the Sheriff of the Court). 

A further reality is that when attorneys instruct tracing agencies they do so in terms of SDT regardless of the quantum of the claim against a debtor. (And why not? There are many tracing agencies competing for the trace instructions of legal practitioners/registered debt collectors and it is in client’s interests to trace defaulted debtors for as little cost as possible.) However, when the quantum of a claim is significant, clients are prepared to risk greater sums than the fee a SDT to successfully trace a debtor. Recognizing this, FSG has introduced its SECOND-PHASE TRACING ('2PT) service.

2PT is performed by FSG’s Investigation Division. FSG is unique in its capacity to offer both a SDT service and what we branded a 2PT service because FSG is foremost a forensic investigation service provider.

The scope of work of a 2PT mirrors that of a MISSING/SOUGHT PERSONS investigation, although its objective is the same as a SDT.

When our Tracing Division produces a 'no trace report' consequent to an unsuccessful SDT, our 'no trace report' includes an offer to conduct a 2PT. 2PT is performed against our base investigation/audit/risk management tariff, and instructions are accepted on condition that client agrees to the following:

  • A minimum budget equivalent to three hours of our time against our base investigation/audit/risk management tariff. We do not warrant that this sum is adequate to complete the task, but we do undertake to not do any work in excess of what this budget permits without first reverting, accounting, and seeking a further mandate if we are still unsuccessful upon exhaustion of the budget (but we have established that there are further avenues to pursue).

  • If we are unsuccessful in locating the debtor, to pay only our disbursements and database search fees, which could include (but may not be limited to):

    • Our fee to search various databases.

    • Our fee to obtain records from confidential databases through informants.

    • Vehicular travelling against our vehicular travelling rate.

FSG is aware that our 2PT service can be misconstrued to be a scheme devised to make quick money for minimal effort, but we encourage clients to draw confidence from the following:

  • This relatively new addition to our service bouquet will only succeed commercially if clients have faith in it, and the only way to secure the confidence of clients is to persistently return successful results.

  • The manner in which we have chosen to encourage the confidence of clients is to limit our fee only to our disbursements if we are unsuccessful, so that FSG shares the risk in the event that we are unsuccessful.

  • Our 2PT is marketed exclusively to attorneys with a collections practice/division (and registered debt collectors) under circumstance that the legal community in South Africa is highly organized such that it is easy for attorneys to blacklist an unscrupulous service provider simply by communicating negative assessments of a service provider between themselves. FSG is acutely aware that its value will always only be assessed on our capacity to sustainably produce successful results.
